Attorneys' Fees

Attorney’s fees in workers' compensation are governed by the Arkansas Workers’ Compensation Law.   Under that law, the injured worker owes no attorney fee unless he or she is awarded benefits.  If benefits are awarded, the attorney is entitled to an attorney’s fee equal to twenty-five percent (25%) of any indemnity benefits awarded (such as temporary total disability benefits, permanent partial disability benefits, etc.)  Attorney's fees are not paid on medical benefits or services that may be awarded.   The injured worker is only responsible for one half of the attorney's fee (12.5% of the benefits), which is withheld from the compensation awarded. The employer or insurance company is liable for the remaining one half of the fee in addition to the compensation they must pay the worker. The injured worker is never asked to pay any fee out of pocket.
